Until the new rent law (Housing Stability and Tenant Protection Act of 2019) took effect mid-June 2019, if a tenant was paying a "preferential" rent, which an owner agrees to charge and is lower than the maximum legal regulated rent that the owner could lawfully collect, the owner was allowed to increase the rent up to the maximum legal regulated rent, even if the increase is greater than the rent increase guidelines that are in effect. Under the new law, the preferential rent becomes the base rent for the term of the tenancy.

Increases for Roberts tenants and lottery tenants follow different rules.
