The Appellate Division has scheduled oral argument on MetLife’s appeal of Justice Lowe’s July 30, 2010 retroactivity decision for Wednesday, April 27, at 2 pm.
In a letter hand delivered to Justice Richard B. Lowe, General Counsel, Gary R. Connor for the New York State Division of Housing and Community Renewal (NYS DHCR) asked for a two week extension to submit its non-binding advisory opinion on the Roberts/J51 rent calculation formula question. The letter cites the “potential impact of DHCR’s submission and the arrival of a new Commissioner on April 4th, 2011”. The advisory opinion was due today, Friday April 1st, 2011.
