Rent Regulation System is Strengthened for the First Time In Decades

The State Senate passed S5856 removing the last hurdle to renewal of the laws.  Shortly after, the Assembly passed a similar bill.  The Association will pass along further details and statements as soon as we can.

Below are the key components of the bill that fortified the regulations for the first time since the late 80’s:

  The laws are renewed for 4 years, until 2015
  Vacancy Decontrol threshold raised to $2,500
  High Income - Hi Rent Decontrol threshold raised to $2,500 and income level is raised to $200,000
  Individual Apartment Improvement pass-along charge is changed from 1/40 to 1/60 ONLY in buildings with 35 units or more
  Vacancy bonus is limited to once a year
  The word “decontrol” is changed to “deregulation” throughout the bill
  DHCR is explicitly required to:
  “Promulgate rules and regulations to implement and enforce all provisions of this act and any law renewed or continued by this act.”
